2016620日、最高裁は2011年のAIAで設立されたIPRInter Partes Review: 当事者間のレビュ)手続きに関するCuozzo Speed事件の判決をだした。下級審CAFCの判決(2015年)を支持した。2つの争点があり、1つ目はIPRを開始するか否かのUSPTOの判断は最終判断か否か(控訴の余地なしか?)、2つ目はIPRにおけるクレーム解釈の基準はBRI(Broadest Reasonable Interpretation:当事者にとって合理的に最大限広範な意味合い)が妥当するのか?

最高裁の判決(Breyer裁判官によるOPINION

1争点:AIA_35 USC §314(a)の条文で明白に規定されている通りUSPTOの判断は確定(最終)判断とし控訴不可である。

2争点:AIA_35 USC §316(a)(4)で規定されているように、IPRにおけるクレーム解釈基準はUSPTOに決定する権限が与えられている。PTOが採用したBRI基準は再審査、インターフェアランス等の基準と同じで妥当性を否定されるものではない。

上記判決に至ったメインの理由はAIA2011America Invents Act)で立法された条文の文言にある。本最高裁判決によってIPRは今後も暫くの間はPatentに対するDeath-Squadの位置づけが維持されるであろう。裁判におけるクレーム解釈基準は明細書を参酌し当業者にとっての一般的な意味合いと解釈し、さらに無効を主張する側の挙証責任は明白且つ説得性のある証拠である。それに対してPTABUSPTO)ではクレーム解釈はBRI基準で行い、無効を主張する側の挙証責任は証拠の優越性である。即ち、PTABPTO)ではクレームを最大限広く解釈し、無効の挙証責任も低いので(訴訟にて無効にするのと比べて)クレームを無効にしやすい。 依って、Cuozzoが主張するように発行された特許は裁判においてその有効性が維持されたとしても後にPTABで無効にされる可能性が生じる。この点に関して最高裁は冷ややかである・・・長年に渡ってそうなのだ・・、特許クレームの有効性判断に対するダブルトラックの現実を認識しており、連邦議会が行政庁に規則の制定権を付与していることに起因するもので仕方ないではないかと述べている。但し、USPTOが当該BRI基準を裁判での解釈基準に変更することも可能であると付け加えている。

しかし本件特許(Cuozzo特許)はPTABの基準(BRI基準)であっても裁判での基準(一般的な意味合い)であっても、さらに挙証責任が何れであっても(証拠の優越性 v. 明白且つ説得性のある証拠)無効となっていたであろう(以下特許発明の概要を参照方)。USPTOLee長官は今回の最高裁判決に対し賛辞を述べておられる。(以上筆者)

特許発明の概要:

速度リミットの表示器に関する発明でGPSを利用し車両が走行する道(Road)の制限速度を検知し、当該速度に応じて赤色のセロファン部材18が速度表示器内で回動しその左側端部で制限速度を表示する。例えば赤色セロファン部材18の左側端部が65MPHに位置するときは当該走行道路の制限速度は65MPHである。走行速度が当該制限速度を超えると速度表示針20(白色)が赤色セロファン18の裏面に入り、赤く見えるためにドライバーに速度違反を警告するという発明である。

上記Cuozzo特許に対して2012GarminIPRを申請した。GarminIPR申請書において、3件の先行技術文献(Aumayer-USP6633811; Evans-USP3980041; Wendt-USP2711153)に基づき上記特許クレーム17は自明であると主張した(親クレームであるクレーム10の自明性を主張するのが通常であるのに・・筆者)。PTABGarminの主張の意味するところはクレーム101417の全てが自明であると理解し、これら3項のクレームの有効性をレビュした。PTABGarminが提出した3つの先行技術によってこれら3つのクレームを自明と判断した。即ち、Aumayer特許はGPSを利用して車両走行場所の制限速度を検知することを開示しており、Evans特許は回動可能な制限速度を示す回動可能な表示部材を開示しているので当業者がそれらを組み合わせることでCuozzo特許のクレームは自明であると判断した。

Cuozzoは当該PTABの判断を不服とし、さらに、PTABIPR申請に対して受理/不受理の判断の妥当性を裁判所で判断できないのは理不尽であり、さらに、IPR手続きでクレーム解釈にBRI基準を採用するのは妥当性を欠くとして控訴した。CAFCの多数意見(意見が分かれた)はPTABの判断は控訴不可であること(第1争点)、PTABにおけるクレーム解釈(IPRにおいて)はBRI基準が妥当する(第2争点)と判断した。

CuozzoCAFCの判断を不服とし裁量上告し、本法廷(最高裁)は上告受理した。最高裁では上記2つの争点に対して審理した。

1争点に関して:

AIA2011年アメリカ発明法改正)によって当事者系再審査に取って代わってIPR (inter-Partes Review)という手続きが新たに設立された。AIAの米国特許法第314(a)項に規定されているようにIPRを開始する基準は”a reasonable likelihood that the challenger would prevail with respect to at least 1 of the claims…IPRを申請する者の少なくとも一部に関して合理的な勝率が予想されるか否か:即ち、少なくとも一つのクレームが無効になるということが合理的に予想されるか否か)である。PTOがこの判断基準に基づきIPRを開始するか否かを判断する。AIA米国特許法314(d)において、当該基準に基づくPTOの判断は確定的な判断であり控訴できないと明白に規定している。

(a)Threshold.—

The Director may not authorize an inter partes review to be instituted unless the Director determines that the information presented in the petition filed under section 311 and any response filed under section 313 shows that there is a reasonable likelihood that the petitioner would prevail with respect to at least 1 of the claims challenged in the petition.

(d)No Appeal.—

The determination by the Director whether to institute an inter partes review under this section shall be final and nonappealable.

2争点に関して:

IPRにおけるクレーム解釈にBRI基準を採用すると決定したPTOの判断はPTOに与えられた規則を制定する権限(AIA 35 USC316(a)(4))に鑑みて適切であると理解される。もし法律の条文に不明な箇所がある場合には、条文の文言、状態、及び、目的に鑑みて議会が行政庁に妥当な規則の制定権を付与していると本法廷(最高裁)は理解する。本事案に関していうと条文は行政庁に規則を制定する権限を与えているということに疑いの余地はない。

35 U.S.C. §316- Conduct of Inter Partes review

(a)Regulations.—The Director shall prescribe regulations—

(4)  establishing and governing inter partes review under this chapter and the relationship of such review to other proceedings under this title;

さらに、条文のどの箇所にもクレーム解釈に対する基準を特定する記載はない。PTOの規則制定に対する権限は、手続きに対する規則に限定されるものではない。

IPRの特質及び目的に鑑みてもPTOに特定のクレーム解釈基準を適用することを要請するものではない。IPRは発行された特許の有効性をレビュする裁判のような手続きとしてできたものなので通常の意味合いで判断するという訴訟(裁判所)で採用されている基準が妥当するとCuozzoは主張する。しかし、IPRは訴訟というよりは寧ろ行政庁における特殊な手続きという位置づけである(権利者はクレームを減縮補正する機会もあり、AIAIP-re-examinationからIP-reviewに呼称は変わったが再審査手続きにより近い: see 35 USC 316(d))。IPRの目的は当事者間における特許紛争を解決するということに加えて、特許の排他権が法外なものとならぬよう適正な範囲にあるという民間(公共)にとっての最も重大な関心に答えるためである。条文、その目的、立法趣旨のいずれにもクレーム解釈にどの基準を採用するかを言及或いは示唆している箇所はない。

PTOの基準がBRIで、裁判所の基準が通常の意味合い基準でクレームを判断すると裁判所ではクレームの有効性が維持されたとしてもPTOでクレームが無効になる可能性があるという理不尽な事情が発生するとCuzzoは反論するが、我々(最高裁)もその状況を理解している。しかしこのダブルトラックのレビュ基準は長年継続されてきたもので究極的には連邦議会がそれを容認した(行政庁に規則制定権を与えた)ことに起因する。再審査における解釈基準もインターフェランスにおける解釈基準もBRIである。特許法の条文にこれらの手続きをIPRに統合することを許可している。裁判所におけるクレーム解釈基準との非整合性を調整(調和)することよりも、庁内におけるクレーム解釈基準を統一することを良しとしたPTOの判断は妥当性を欠くとはいえない。

尚、PTOが付与された規則制定権に基づき、将来、裁判所のクレーム解釈基準(Cuozzo及び裁判所の助言者の主張)を採用するか否かはPTO自身で決めることだ。

35 U.S.C. §314 – Institution of Inter Partes Review

 (a) Threshold.—

The Director may not authorize an inter partes review to be instituted unless the Director determines that the information presented in the petition filed under section 311 and any response filed under section 313 shows that there is a reasonable likelihood that the petitioner would prevail with respect to at least 1 of the claims challenged in the petition.

 (b) Timing.—The Director shall determine whether to institute an inter partes review under this chapter pursuant to a petition filed under section 311 within 3 months after—

(1)  receiving a preliminary response to the petition under section 313; or

(2)  if no such preliminary response is filed, the last date on which such response may be filed.

(c) Notice.— The Director shall notify the petitioner and patent owner, in writing, of the Director’s determination under subsection (a), and shall make such notice available to the public as soon as is practicable. Such notice shall include the date on which the review shall commence.

(d)No Appeal.— The determination by the Director whether to institute an inter partes review under this section shall be final and nonappealable.

35 U.S.C. 316- Conduct of Inter Partes Review

|

 (a) Regulations.—The Director shall prescribe regulations—

(1)  providing that the file of any proceeding under this chapter shall be made available to the public, except that any petition or document filed with the intent that it be sealed shall, if accompanied by a motion to seal, be treated as sealed pending the outcome of the ruling on the motion;

(2)  setting forth the standards for the showing of sufficient grounds to institute a review under section 314(a);

(3)  establishing procedures for the submission of supplemental information after the petition is filed;

(4)  establishing and governing inter partes review under this chapter and the relationship of such review to other proceedings under this title;

(5) setting forth standards and procedures for discovery of relevant evidence, including that such discovery shall be limited to—

(A)  the deposition of witnesses submitting affidavits or declarations; and

(B)  what is otherwise necessary in the interest of justice;

(6)  prescribing sanctions for abuse of discovery, abuse of process, or any other improper use of the proceeding, such as to harass or to cause unnecessary delay or an unnecessary increase in the cost of the proceeding;

(7)  providing for protective orders governing the exchange and submission of confidential information;

(8)  providing for the filing by the patent owner of a response to the petition under section 313 after an inter partes review has been instituted, and requiring that the patent owner file with such response, through affidavits or declarations, any additional factual evidence and expert opinions on which the patent owner relies in support of the response;

(9)  setting forth standards and procedures for allowing the patent owner to move to amend the patent under subsection (d) to cancel a challenged claim or propose a reasonable number of substitute claims, and ensuring that any information submitted by the patent owner in support of any amendment entered under subsection (d) is made available to the public as part of the prosecution history of the patent;

(10)  providing either party with the right to an oral hearing as part of the proceeding;

(11)  requiring that the final determination in an inter partes review be issued not later than 1 year after the date on which the Director notices the institution of a review under this chapter, except that the Director may, for good cause shown, extend the 1-year period by not more than 6 months, and may adjust the time periods in this paragraph in the case of joinder under section 315(c);

(12)  setting a time period for requesting joinder under section 315(c); and

(13)  providing the petitioner with at least 1 opportunity to file written comments within a time period established by the Director.

 (b) Considerations.—

In prescribing regulations under this section, the Director shall consider the effect of any such regulation on the economy, the integrity of the patent system, the efficient administration of the Office, and the ability of the Office to timely complete proceedings instituted under this chapter.

 (c) Patent Trial and Appeal Board.—

The Patent Trial and Appeal Board shall, in accordance with section 6, conduct each inter partes review instituted under this chapter.

 (d) Amendment of the Patent.—

(1)In general.—During an inter partes review instituted under this chapter, the patent owner may file 1 motion to amend the patent in 1 or more of the following ways:

(A)  Cancel any challenged patent claim.

(B)  For each challenged claim, propose a reasonable number of substitute claims.

(2)Additional motions.—

Additional motions to amend may be permitted upon the joint request of the petitioner and the patent owner to materially advance the settlement of a proceeding under section 317, or as permitted by regulations prescribed by the Director.

(3)Scope of claims.—

An amendment under this subsection may not enlarge the scope of the claims of the patent or introduce new matter.

 (e) Evidentiary Standards.—

In an inter partes review instituted under this chapter, the petitioner shall have the burden of proving a proposition of unpatentability by a preponderance of the evidence.
