2011年4月18日に合衆国最高裁にて、口頭審理が開かれました。 特に重要な争点は、審査段階で考慮されなかった先行技術で無効を主張するときの挙証責任の基準は「明白且つ説得性のある証拠: Clear and Convincing evidence:以下C&C基準とも称する」によるべきか、それとも「証拠の優越性: Preponderance of Evidence: 以下、P基準とも称する」の基準によるべきかである。

 

過去の最高裁の判決(Festo事件; KSR事件; Bilski判決など)を参酌すると、最高裁はCAFCの硬直的なルールに対しては何らかの緩和策(或いは例外)を認めてきましたが、今回はCAFCの判決を真っ向から支持しました。 即ち、審査段階で提示されなかった証拠に基づく無効を主張する場合であってもC&C基準が妥当するという判決となりました。

 

この判決によって 、米国特許に対する信頼を基礎とするライセンス契約、ビジネス、投資、経済活動に対する従来レベルの安定性が担保されたと考えます。

本事件の背景:

2007年にi4i社は米国特許5787449号を基に、MS社を相手にテキサス州東部地区連邦地裁に侵害裁判を提起した。 当該特許はドキュメントの編集ソフトに関し、ドキュメントの構成と関連するメタコードとドキュメントのコンテンツを別個に記憶するという手法をクレームしている。 

 

Claim of US 5787449  (A)
1. A computer system for the manipulation of the architecture and content of a document having a plurality of metacodes and content by producing a first map of metacodes and their addresses of use in association with mapped content; said system comprising:
metacode map distinct storage means;
means for providing a menu of metacodes to said metacode storage means;
and means for compiling said metacodes of the menu by locating, detecting and addressing the metacodes in the document to constitute the map and storing the map in the metacode storage means; and
means for resolving the content and the metacode map into the document.

 

i4i社はMS社のワードXML編集ソフトを侵害対象物とし、故意侵害を訴えた。 MS社の抗弁としては、当該特許は、出願日の1年より前のi4i社の販売行為(*1) により102条(b)項の基に無効であると主張した。 MS社は、当該販売行為は特許庁で審査されていないので、当該販売行為を証拠として無効を主張するMS社の挙証責任の基準は「証拠の優越性:Preponderance of Evidence」が妥当すると主張した。

 

(*1) 同販売行為の対象となるソフトウェア(S4と呼称される)のソースコードは本件訴訟が提起される何年も前に廃棄処分されていた。 従って、この事実問題(米国出願日の1年より前にi4i社による販売行為があったか否か)は、i4i社のソフトウェアS4の開発者と本件特許の発明者の裁判における証言に大部分を依存しなければならなかった(これらi4i社側の証人はソフトウエアS4には本件特許の発明は含まれていなかったと証言した)。 

 

MS社はこの挙証責任の基準(新しい証拠を基礎とする無効の挙証責任の基準はP基準である)を陪審に説示するように裁判官に求めたが、却下され、同地裁は最終的には特許の無効を認めず、MS社に290Millionドル(約250億円)の支払いを命じた。 損害賠償金だけではなく、MS社の特定バージョンのワードソフトの販売の差止めを命じた。

 

同判決を不服とし、MS社は控訴したが、CAFC(3人の判事による通常の裁判)においても地裁の判決が支持された(2010年)。 MS社は、合衆国最高裁に上告し、最高裁が裁量上告を認め20101129日)、2011 418日の口頭審理を経て、この度(201169)最高裁判決がだされた。

判示: 米国特許権を無効にするための挙証責任の基準は米国特許法第282条に基づきC&C基準である。

   

(A) MS社の主張、「被告が特許無効を主張する場合のその挙証責任の基準はP基準が妥当する」は誤りである。

 

米国特許法第282条は成立した米国特許には有効性の推定が働くことを規定している。 しかし、当該有効性の推定に反証する側の挙証責任の基準に関しては明瞭には言及していない。  しかし連邦議会はコモンローの用語を使用しているので、コモンローの意味合いで当該用語を解釈する・・・Safeco Ins. Co. of America v. Burr。 本事件において、282条で「特許はその有効性が推定される」と記載することで、議会はコモンローですでに確立した用語を用いたのである。 Radio Corp of America v. Radio Engineering lab. Inc. (以下RCA判決)」、がその根拠(権威)であり、同判決文において、成立した特許に付随する有効性の推定は、Clear and Cogent (C&C基準と等価:筆者注)な証拠によってのみ反証できるとある。 

 

Justice Cardozo wrote for a unanimous court that "there is a presumption of validity, a presumption not be overthrown except by clear and cogent evidence."

 

MS社の主張、「1952年以前(現行1952年特許法の成立前)の判決においてC&C基準を限定的に適用した先例がある」は権威のある判決(最高裁判決)で支持されていない。

 

(B) MS社の主張、「審査段階で考慮されてない証拠で無効を主張する場合にはその挙証責任はP基準が妥当する」は誤りである。

 

MS社の主張するような事象(PTOで審査されなかった新規な証拠で無効を主張する)においては、審査官が専門家として特許を認めたという、即ち「有効性の推定」の基礎をなす理由の大部分が失われるであろうということは正しいKSR v. Teleflex (最高裁判決:2007年)。 しかし、連邦議会が適応されるべき挙証責任の基準を規定したのかが問題である。 本裁判所の本判決で確定しているように、連邦議会はコモンローに基づき特許有効性の推定を明文化し、非明示的に挙証責任の基準を高くしたのである。

 

1952年以前(現行特許法の成立前)の判決(最高裁判決)において、MS社が主張するように変動する挙証責任の基準を採用したものはない。 それら最高裁判決で、無効の抗弁においてC&C基準を下回るということを傍論においても示したものはない。 寧ろ、その逆で(RCA判決参照)同判決においては関連する先行技術が審査官に審査されたか否かということを言及せずに、高い挙証責任の基準(C&C基準)を示した。 282条の文言のいずれの箇所にも連邦議会(起草者)が挙証責任の基準を事実に鑑み変動(調整)するということを意図していたという記録がない。 もしも議会がそのような挙証責任の変動(調整)を意図していたならば、議会はそれを条文に盛り込んだであろう。

 

1952年以前の下級審(12の連邦控訴裁判所:1982年CAFC設立の遙か前)において審査段階で引用されていない証拠による場合には、有効性の推定が弱まるとか、推定が喪失するという判断が下された場合があるが、これら判決は常識的な意味合いで理解するべきである。 即ち、審査されていない証拠に基づき無効を検討するので、特許庁の過去の判断(特許を認めたという審査官の判断)はその効力を発揮することはできない。 この考えの下に、陪審説示として、裁判における証拠は実質的に新規で特許の有効性判断にとって重要なものであるということを述べても良い。

 

(C) 連邦議会がC&C基準を採用したことによる見識に関して両当事者および裁判所の助言者(amici)によりあれこれ議論が出されたが最高裁はそれらに判断をくだす立場にない。 連邦議会はコモンローに基づく有効性の推定を1952年の特許法第282条で成文化した、これによって挙証責任の基準が明確化されたのである。 約30年間に亘りCAFCは282条の意味合いを今日の最高裁と同じように解釈してきた、さらに、連邦議会は282条ならびに1952年特許法の条文を何度も改訂してきたが、挙証責任の基準を下げることに関しては一度の提案すらなかった。 実際のところ、連邦議会はCAFCにその判断を委ねてきたのである。 然るに、挙証責任の基準を再度調整するということになれば(今回最高裁が判断を下したので)、今後、それは連邦議会の仕事となる。

多数意見に賛同するが、本事件で争点となっている事実に基づく挙証責任の基準は事実問題にのみ適用されるが、法律問題には適用されないという点を強調しておきたい。 即ち、事実問題の判断者(陪審裁判の場合には陪審)は、先に販売があったか否か、あるいは、先行技術が公開されたか否かというようなことが事実問題の判断であり、このような判断にC&C基準が適用される。

多数意見に賛同するが、282条に挙証責任が明白に盛り込まれているという解釈には同意できない。 しかし282条に挙証責任が明示されていないということは、コモンローによる挙証責任の基準を否定するものではないので結論は多数意見と同じである。

35 U.S.C. 282 Presumption of validity; defenses.

 

A patent shall be presumed valid. Each claim of a patent (whether in independent, dependent, or multiple dependent form) shall be presumed valid independently of the validity of other claims; dependent or multiple dependent claims shall be presumed valid even though dependent upon an invalid claim. Notwithstanding the preceding sentence, if a claim to a composition of matter is held invalid and that claim was the basis of a determination of nonobviousness under section 103(b)(1), the process shall no longer be considered nonobvious solely on the basis of section 103(b)(1). The burden of establishing invalidity of a patent or any claim thereof shall rest on the party asserting such invalidity.

 

The following shall be defenses in any action involving the validity or infringement of a patent and shall be pleaded:

 

(1) Noninfringement, absence of liability for infringement, or unenforceability,

(2) Invalidity of the patent or any claim in suit on any ground specified in part II of this title as a condition for patentability,

(3) Invalidity of the patent or any claim in suit for failure to comply with any requirement of sections 112 or 251 of this title,

(4) Any other fact or act made a defense by this title.

In actions involving the validity or infringement of a patent the party asserting invalidity or noninfringement shall give notice in the pleadings or otherwise in writing to the adverse party at least thirty days before the trial, of the country, number, date, and name of the patentee of any patent, the title, date, and page numbers of any publication to be relied upon as anticipation of the patent in suit or, except in actions in the United States Court of Federal Claims, as showing the state of the art, and the name and address of any person who may be relied upon as the prior inventor or as having prior knowledge of or as having previously used or offered for sale the invention of the patent in suit. In the absence of such notice proof of the said matters may not be made at the trial except on such terms as the court requires.

Invalidity of the extension of a patent term or any portion thereof under section 154(b) or 156 of this title because of the material failure-

(1) by the applicant for the extension, or

(2) by the Director, to comply with the requirements of such section shall be a defense in any action involving the infringement of a patent during the period of the extension of its term and shall be pleaded. A due diligence determination under section 156(d)(2) is not subject to review in such an action.
